As a general taxation rule in Georgia, if an individual sells an apartment after holding it for more than two years from the date of purchase, the capital gain received from the sale is exempt from personal income tax in Georgia. If the apartment is sold within two years, the capital gain is generally taxed at the 5% rate.
⚠️ However, the new Public Decision published by the Ministry of Finance of Georgia clarifies that these rules do not apply to every case of the sale of an apartment by an individual.
