The One Big Beautiful Bill (OBBB) Act’s
§225, the section that makes FLSA-qualified overtime compensation tax free.
Taxes you must continue to apply to overtime pay:
FITW, F**A, Medicare and FUTA.
Maximum overtime pay deduction for marrieds filing jointly: $25,000, phasing out at
$300,000; singles: $12,500, phasing out at $150,000.
The tax-free part kicks in when employees complete their 1040, where they can take an “above-the-line” deduction for their overtime pay. Above-the-line deductions are taken before adjusted gross income is computed and are available regardless of whether the filer itemizes deductions on Schedule A. Expect a new line on the 1040 before filing season.
