This tax season marks an important shift for trusts in South Africa. From 4 May 2026, SARS now applies automated monthly penalties to all non compliant trusts - active or dormant. SARS has taken a zero tolerance approach, increasing scrutiny of trust administration and enforcing penalties and interest that can rapidly accumulate.

If your trust is inactive, behind on returns, or uncertain in its compliance status, it remains fully exposed until deregistered. Trustees are personally responsible for ensuring all obligations are met.
