National Treasury has proposed tightening the donations tax exemption between spouses, specifically targeting a tax planning strategy used by some wealthy couples during emigration.

Currently, transfers between spouses are exempt from donations tax, but the draft amendment would only allow this exemption if the receiving spouse is still a South African tax resident at the time of the donation.

The concern is a specific arrangement where one spouse becomes a non-resident first, the other spouse then transfers substantial assets under the exemption, and only afterwards does that second spouse also exit South African tax residency with a smaller asset base, reducing the tax normally triggered when someone leaves the tax system.

If enacted, the amendment would apply retrospectively from 25 February 2026, meaning couples who've already made transfers since that date may need to review their position.

Treasury has been clear that ordinary couples with different residency timelines for legitimate reasons, like work, schooling, or family care, are not the target.

Did you know? During tax season, SARS is opening it branches to help taxpayers stay compliant, on Saturdays.

SARS has announced that select branches will open on Saturdays throughout tax season to make it easier for taxpayers to get assistance without needing to take leave.

Running from 25 July through to October, participating branches will generally be open from 08:00 to 13:00, with some smaller branches like Rustenburg, Mmabatho, and Klerksdorp offering slightly shorter hours.

Eastern Cape residents get extended access, with Kariega, Gqeberha, East London, and Mthatha open every single Saturday until 24 October.

This is a great option for anyone with complex tax queries who prefers face-to-face assistance over eFiling, or who simply hasn't had time during the week to sort out their tax affairs.

Well-intentioned business decisions can turn into expensive tax headaches if the tax implications aren't considered upfront.

Simple gestures like a solar subsidy for remote employees, or even a daily meal allowance for a driver can carry unexpected tax consequences.

A growing chorus of financial experts is questioning whether Capital Gains Tax (CGT) is fair in an economy that is plagued by persistent inflation.

Michael Treherne, a director at Vestact Asset Management, shared his frustration after selling Nvidia shares with a 6,000% gain, noting that investors don't receive any inflation adjustment to their base purchase price.

In South Africa, where prices tend to double every 7 to 10 years, investors can be taxed heavily even when much of their ""gain"" simply reflects keeping pace with inflation rather than real wealth creation.

Dr Brian Benfield, a retired economics professor from Wits University, went further, arguing that CGT effectively taxes phantom gains created by currency depreciation.

Currently, people can exclude the first R50,000 of a capital gain in the 2026 tax year, with 40% of any gain above that added to their taxable income.

The core argument from critics is that capital gains should be calculated on real, inflation-adjusted returns rather than nominal gains, since a 10% nominal return during a period of 6% inflation only represents a 4% real return.
