Jerry Don Beebe, 67, owner of a waterslide attraction, has pleaded guilty to making a false return because he did not want to pay additional taxes.

He owned and operated Beebe’s Roaring River Waterslide during the period under investigation from 2015 to 2018. Beebe’s records showed gross receipts of $135,282 for 2017 (when he reported $24,535 on his return) and $145,451 for 2018 (when he reported $29,172 on his return).

Now Beebe must pay $141,648 in restitution for unpaid federal and Missouri taxes and faces up to three years in prison. Is it really worth it to try to hide from the IRS a few years?

A couple who reported only losses from horse racing activities from 1995–2010 were determined to be engaged in their thoroughbred activity with an intent to make a profit. The years under audit were 2009 and 2010. The court examined the nine factors under the regulations and determined that the preponderance of the evidence weighed in the taxpayers’ favor.

The strongest factor, in the court’s opinion, was the fact that the taxpayer carried on the business in a professional manner consistent with a profit motive. Additionally, the Tax Court stated that the expertise of the taxpayer, his time and effort in running the activity, the likelihood that the assets would increase in value, and the minimal occasional profits that were earned weighed sufficiently enough for it to rule in the taxpayer’s favor (Mel A. Annuzzi and Jean L. Annuzzi v. Comm., TC Memo 2014-233).

Why is it important for businesses to maintain updated financial records?

The importance of maintaining contemporaneous records should be emphasized to your clients. Many individuals believe that they can re-create the records if necessary for an audit.

The case of Alvaro G. Velez v. Commissioner, T.C. Memo 2018-46 emphasizes the problem with this approach. The taxpayer was an attorney who was denied the deduction for car and truck expenses because he failed to produce substantiation requirements. He provided records made on his iPad calendar purporting to show his automobile use.

However, he created them several years after the relevant automobile use and long after he had full present knowledge of each element of each expenditure or use. Additionally, the calendar used to create the logs was not available and the Court ruled that credit card statements and other documents were insufficient to corroborate the business purpose or location of the claimed expenditures.
