Smart people make costly IRA mistakes, too! 🤭💸

We'll explore real-life cases where IRA owners, beneficiaries, and financial professionals made decisions that seemed perfectly reasonable—until the IRS or the courts saw things differently. 😳

💰 What went wrong?

⚖️ What were the tax consequences?

💡 And most importantly, how could those mistakes have been prevented?

I had the honor of presenting “Retirement Assets in Estate Planning: Costly Mistakes That Derail Plans” at WealthCounsel, LLC's 2026 Symposium.

The audience of legal professionals was engaged, and I appreciated the thoughtful questions and conversations afterward. It is always a pleasure to discuss the practical issues that arise when retirement assets are part of an estate plan.

Thank you to WealthCounsel for the invitation and to everyone who joined me.

The Bureau of Labor Statistics reports that, in March 2026, 72% of private industry workers had access to a retirement plan, while 52% participated. For defined contribution plans, the figures were 70% and 49%.

That gap deserves attention, but it does not tell us why an individual worker did not participate. Eligibility rules, enrollment practices, affordability, and other circumstances can all matter.

For employers and advisors, the useful question is: Are workers who can participate getting the information and support they need to make a decision?

I wrote a letter to the IRS. IRS Notice 2026-49 proposes standardized forms and a five-step process for rollovers involving employer plans. I welcome the effort to have the institutions communicate directly, instead of leaving the account owner to carry instructions between them.
I submitted a comment letter to Treasury and the IRS recommending additional safeguards that I believe would help everyone involved, particularly participants and beneficiaries. You can read it here: https://www.regulations.gov/comment/IRS-2026-0100-0006

Should IRA checkbooks be used for QCDs?
IRA owners have been using IRA checkbooks to make Qualified Charitable Distributions for years.
But the IRS's new Code Y reporting requirement has brought an interesting question to the surface: Does a check signed by the IRA owner, but drawn directly on the IRA, satisfy the requirement that a QCD be made directly by the IRA trustee?
IRA custodians don't all appear to be taking the same position.
And that raises another important question: Does it really matter how the custodian reports the distribution if the taxpayer is ultimately responsible for determining whether it qualifies as a QCD?
I explore the issue, the different custodian approaches, and what IRA owners using checkwriting for charitable gifts should consider in my latest Morningstar, Inc. article:
Should IRA Checkbooks Be Used for QCDs? https://www.morningstar.com/personal-finance/new-qcd-reporting-rule-raises-big-question-ira-owners — Morningstar

The 60-day rollover rule is strict and unforgiving. ⏳

Miss the deadline, and the distribution could become taxable and may be subject to penalties.

In addition, only one 60-day rollover is permitted per 12-month period across all IRAs, making direct transfers the safer option.

A surviving spouse has more retirement account options than any other beneficiary.

Depending on the circumstances, a spouse may keep the account inherited, move the assets to their own retirement account, use the 10-year rule, or take life-expectancy distributions.

SECURE 2.0 added another possibility, and the proposed regulations explain how it would work: The spouse may retain beneficiary status while using the Uniform Lifetime Table to calculate RMDs.

Each option can produce different results for RMDs, taxes, access before age 59½, and successor beneficiaries.

That is why advisors must understand not only which options are available, but also which option best fits the client. Before making a recommendation, confirm what the governing document permits and how the plan administrator or IRA custodian is applying the new rules.
