Before Q3 gets busy, it's worth taking a few minutes to make sure your payroll is set up to handle what's coming. A few things worth checking:

How often should we check in with an employee to make sure an ADA accommodation is still meeting their needs?

Answered by the HR Experts:
You should check in as often as it makes sense under the circumstances. There’s no legally required timetable under the Americans with Disabilities Act (ADA).

In general, you should reach out when there’s been some change with the employee or in the workplace that might make the accommodation less effective or no longer necessary. For instance, an employee using a screen reader might benefit from updated software as it becomes available, while an employee who’s allowed to work a different schedule due to temporary insomnia might not need or want that schedule once the condition passes. An employee who uses a wheelchair would likely appreciate a check-in if you plan to remodel the office in a way that could impact their mobility. On the other hand, if there have been no changes that would affect an employee’s accommodation, you could reach out once a year or so if you think there’s a good reason for it.

During a check-in, if an employee tells you that an accommodation is no longer effective or that their needs have changed, you should explore alternative accommodations with them. In other words, restart the interactive process. You can request new documentation if warranted (e.g., the employee says they have a new or worsened health condition requiring new accommodations), but you shouldn’t ask for repeat documentation if their condition hasn’t changed.

Internships offer students opportunities to gain real-world experience and hands-on career development. The most important thing to know is that interns are, in many cases, employees and need to be paid as such. There are some practical things to consider as well.

Here are the steps we recommend you take before hiring an intern:

Determine whether the internship should be paid or can be unpaid. For this, use the Department of Labor’s “primary beneficiary test” explained in the guide linked below. If there’s any doubt about whether an intern should be paid, the safest option is to pay.
Define the internship clearly so both parties understand their duties and expectations, including any pay and benefits offered.
Be clear about how much supervision the intern will receive, and who should be providing it. Reliable supervision is key to preventing problems and maximizing the benefit for both parties.
If the internship is unpaid, get documentation from the intern’s school explaining the educational relevance of the internship and whether it will earn the student credits.
Review your business liability insurance policies for coverage or exclusions of unpaid interns.
Ensure that you’re complying with child labor laws. If you’re hiring minors, federal and state child labor provisions might apply.

How do we handle benefits following the death of an employee?

Some benefits need to be paid or transferred to beneficiaries, while others must be terminated. Both have rules you’ll need to follow.

Beneficiary-driven benefits include life insurance, retirement plans, and health savings accounts. Your obligations include starting the death claim process with the broker and insurer, providing appropriate information and paperwork to beneficiaries, submitting paperwork to the insurer, and following up until the claim has been paid.

Benefits that are not beneficiary-driven should be terminated based on the rules in the plan document and insurer contract. The qualifying event date would be the date of the employee’s death, but the plan’s rules will indicate whether the benefits terminate on the date of death or at the end of the month during which the death occurred. This information will be important for administering COBRA continuation for enrolled dependents. Terminating employer-sponsored group health benefits generally requires an offer of federal COBRA continuation coverage, state mini-COBRA coverage, or both for eligible plans with dependent coverage.
