Tax Tip for New Parents

Many people don’t realize that if you had a baby or adopted a child, you may be able to withdraw money from your retirement account without paying the 10% early withdrawal penalty.

This can apply if you took money out of an IRA, SIMPLE IRA, or 401(k).

The law allows up to $5,000 per parent to be withdrawn within one year of the birth or adoption without the additional early withdrawal penalty. The distribution is still taxable income, but the penalty may not apply.

Many people receive a 1099-R and assume they automatically owe the penalty, but that isn’t always the case.

If you had a baby and took money from a retirement account, make sure your tax preparer knows so it can be reported correctly.

S-Corp Tax Deadline Reminder

S-Corporation tax returns are normally due March 15 each year.

However, because March 15 falls on a Sunday in 2026, the deadline has moved to Monday, March 16, 2026.

If your business files as an S-Corp (Form 1120-S), make sure your return is filed or an extension is submitted by March 16 to avoid penalties.

If each parent has the child exactly 6 months on / 6 months off, the IRS has clear tie-breaker rules for who can claim the child.

IRS Rule (Equal Time Split)

When custody is 50/50, only ONE parent can claim the child.

The parent who can claim the child is:

➡️ The parent with the higher Adjusted Gross Income (AGI) for the year.

This rule applies to:

Claiming the child as a dependent

Child Tax Credit

Head of Household

Earned Income Credit (EIC)

The IRS will not allow both parents to claim the same child—even if one files Head of Household and the other files Single.
