We are just finishing a return that the books and tax return was done by one of the online software platforms - the $199 per month variety.
We picked up the return with a balance due of $34k - $8k due to CA and finished the return with a $1624 federal and $4k state REFUND!

I had a fellow business owner invite me to a weekend of change last January. I've been working the tools both in my personal life and in my business.

Not only have I met and developed business contacts and relationships, but I have discovered and strengthened disciplines in myself and my relationship with my business. (Yes, we all do have relationships with our businesses -- healthy and not)

Hello and Happy New Year!

It's the new year and that means it is almost tax time! To help us get your tax returns filed as quickly as possible, we will need the following information.

If RJHayes Financial Services (Rene') does not do your Federal Tax Returns, no worries. You will still want to collect this information for your tax preparer.

Odometer Reading as of 12/31/2024 for each vehicle - as always, best practice would be to go to Jiffy L**e or similar to have your oil changed (last week of December or 1st week of January). This will give you a third party recording of your odometer and a base line to use from year to year for mileage verification.

We will need to know 100% of all miles driven, whether it was business or personal. And then we will need to know what portion was business and what was personal.

If you are using your personal vehicles for business use, we need to be reimbursing you for the miles driven for business use on a monthly basis. My sure that you have your Accountable Plan updated!

Physical inventory as of 12/31/2024 - if you do not keep inventory, then you can disregard this portion of the email :) We will need to know the value of what was sitting on the shelf as of 12/31/2024.

Is the Corporate Transparancy Act (BOI - Beneficial Ownership Information) dead?

Absolutely not! There are some accountants that are floating the idea that this filing requirement is now no longer needed. This blanket approach could have negative ramifications if the decision is overthrown prior to the deadline for the initial law enactment or the alternative of due to the decision the deadline "could" be extended, but that would be up to congress.

The 5th Circuit ruling on Texas Top Cop Shop Inc. v. Garland, is an injunction NOT a reversal of the law. An injunction is a temporary halt to enforcement or activity. I do believe that it is very likely that this decision will be appealed as it has been upheld by other lower courts.

So for now, you can continue to voluntarily file with FinCEN (Financial Crimes Enforcement Network) a division of the US Treasury Department and get it over and out of the way, OR wait and see what the courts and then congress will decide regarding the deadline extended or not. If you do decide to wait an see, you will want to have your proper documentation ready to go as the 12/31/24 clock is ticking and we have no guarantee that the injunction will extend the deadline.

Either way, the fines for not filing are draconian and while the fines are subject to "willful neglect", after this ruling it will be pretty hard to make a believable statement about not having heard about it.

Most folks know that as I am continuing my journey into Tax Resolution that I've been studying for the US Tax Court "Bar" exam. This would give me the privilege to represent tax payers in audit and exam clear up to the highest level of US Tax Court.

They released the statistics for the exam that I took in November of 2023. Worldwide only 163 practitioners attempted the exam and 10 passed. 6.13% pass rate -- brutal exam! I'm already studying for the next round.
