FAQ: Should I pay them as a subcontractor or a W-2 employee?

We get this question a lot.

The short answer is that you shouldn’t choose simply based on which option is easier or cheaper.

The IRS looks at the relationship between the business and the worker. Things that matter:

✔️ Who controls how the work is done?
✔️ Who sets the schedule?
✔️ Who provides the tools and equipment?
✔️ Can the worker perform services for other clients?

If you’re directing their day-to-day work like an employee, there’s a good chance they should be on payroll. Getting it wrong can lead to payroll tax issues, penalties, and a lot of headaches down the road.

If you’re unsure, ask before you start writing checks. It’s much easier to set it up correctly from the beginning than fix it later.

Things we’ve learned running a business:

We spend a lot of time on social media sharing tax tips, filing deadlines, and other reminders. Of course, those things do matter.

But if we had to give one piece of advice to a business owner, it probably wouldn’t be about taxes at all.

It would be this:

Hire good people.

The right people make your business better. They take ownership, care about your clients, solve problems, and help carry the load when things get busy.

No software, tax strategy, or business plan has a bigger impact on growth than having great people on your team. It’s one of the best investments a small business owner can make.
