RE: Surplus Rebate [Massachusetts]

Many of you received a 'surprise' check this last November (or December) from the Mass Dept of Revenue.
This check was issued to you as a result of a relatively old, obscure directive placed within the state's tax code whereby should the state's annual revenues meet or exceed a certain threshold -- the state is obligated to return to you a percentage of your prior year's income tax liability [a percentage of the actual tax levied and paid by you (net of credits) and/or spouse.]

Without getting into the reasons as to why this refund is (or is not) taxable...suffice to say that it most likely NOT taxable for most of you, although for a sizable minority of you -- it IS taxable (despite what the media might seek to convey.)

If you received a 1099-G from the MA DOR where the amount shown is greater than the actual refund you received last April when you filed your income tax, then you're expected to report this amount shown, and it is 90+% likely that it is now taxable.

Why? Because you took a deduction on your prior year FED tax return for this amount (see Schedule A) -- which was then refunded to you, so thus you benefited from a deduction for a tax that was never actually/ultimately paid.

The IRS has determined whether state-issued rebate payments will count as taxable income for the 2022 tax season after telling taxpayers to delay...
