Many clients ask if they need a Trust. It all depends on what type of property they own.

Property passes in 4 ways:
1) Property Law - Held jointly, auto transfers to joint owner.
2) Contract Law - Named beneficiaries; transfers to listed beneficiary
3) In Trust - Passes according to Trust documents.
4) Probate - Assets in decedents name only go to Probate.

Note in #4, a Will does not avoid Probate!
