The IRS has had a reduction of personnel. Paper mail is delayed in processing not by days but by weeks and months. In the process of upgrading, a number of processes are now being handled electronically.

The first $10,200.00 of Unemployment for 2020 is now not taxed. For those who have already filed, the IRS say they are going to fix this and for those who have not filed you are supposed to wait for the fix. Which will happen first?

The pending COVID relief in Congress could be tied to your last filed tax return. If your taxable income was less in 2020 than 2019, filing before the relief bill is a recommendation. But if your 2020 taxable income is greater than 2019, you might want to consider waiting and even filing an extension if the legislation is not passed right away.

According to The Taxpayer Advocate Service Report, here are the top 10 tax issues which generated court opinions from Jun. 1, 2017 through May 31, 2018 (the most recent data). These haven’t changed much from the prior year. The first nine were all the same, and only the trust fund recovery penalty was new, beating out last year’s “joint and several liability for spouses.” In descending order starting with the most litigated issue, they were:

Accuracy-Related Penalty §6662(b)(1) and (2).

Trade or Business Expenses §162(a) and related Code sections

Summons Enforcement §§7602(a), 7604(a), and 7609(a).

Gross Income §61 and related Code sections.

Appeals From Collection Due Process (CDP) hearings §§6320 and 6330.

Failure to File Penalty §6651(a)(1), Failure to Pay Penalty §6651(a)(2)), and Failure to Pay

Estimated Tax Penalty §6654.

Civil Actions to Enforce Federal Tax Liens or Subject Property to Payment of Tax §7403.

Charitable Deductions §170.

Schedule A Deductions Under §§211-224.

Frivolous issues penalty (§6673 and related appellate level sanctions).

Observation from personal returns.

So far for the 2018 tax season, for a majority of personal returns there has been less of a refund when filing the return but the overall amount of taxes paid have been less due to the change in the withholding tables and the amount of taxes withheld from the individual paychecks.

For most this is a good thing to have the money to spend in the year than let the IRS hold onto it for a year and not earning any interest for the taxpayer.

It is still surprising the number of clients (former) who have the expectation of getting their work done on a timely basis when they are not timely in paying their bills. Especially when they have been continually reminded that their lack of payment is considered an impairment upon the independence of the CPA and prevents additional work from being done on a timely basis.

The deduction on home equity borrowing is currently suspended. Consider if looking to cash out and refinance. Proper record keeping will be needed.
