The random trust audit that found a $3,491.38 problem.

Law firm owners, there are only a few easy ways to lose your license without meaning to. Messing up your trust account is one of them.

Picture a 2‑attorney estate planning firm doing about $600k a year. Good reputation. Steady referrals. From the outside, they look fine.

Inside, the trust account hadn’t been reconciled in six months.

Everyone assumed someone else was handling it. There “wasn’t that much” moving through trust anyway, so it never felt urgent… until a random Tuesday.

The owner grabs the mail and sees an envelope from the state bar with his name on it.

“You have been randomly selected for an audit of your trust account.”

He has 30 days to certify that the trust account is reconciled and in good standing.

He does what most good lawyers do when they’re out of their depth: opens
Google and tries to DIY a three‑way reconciliation.

When we finally looked at the numbers, the trust bank balance and trust ledger were off by $3,491.38. Not a clean, obvious mistake. Just wrong.

We went month by month, matching:
1. Trust bank balance vs trust ledger
2. Trust ledger vs individual client ledgers
3. Clearing old items and obvious red flags

Thirty days later, the math worked, the documentation was clean, and he could sign that certification without crossing his fingers.

1. Does your trust liability report equal your trust bank balance today?
2. Are you getting a true three‑way reconciliation every single month?
3. Are there any items on your recon older than 60 days you can’t clearly explain?
