🚨 STOP letting H&R Block (or anyone) tell you that you can’t claim your baby because they were born at the end of the year. 🚨

❌ That is NOT an IRS rule.

👶🏽 IRS FACT:
If your baby was born ANY day during the tax year — even December 31st at 11:59 PM — you CAN claim them as long as they have a valid Social Security Number.

📌 IRS Rules for Claiming a Newborn:

✔️ The child must be born alive during the tax year
✔️ The child must have a valid Social Security Number (issued before you file)
✔️ The child lived with you — the IRS considers a newborn to have lived with you the entire year
✔️ You provided more than half of the child’s support
✔️ The child is your son or daughter (biological or adopted)

🚫 There is NO 6-month requirement for newborns.
That rule applies to qualifying relatives, NOT qualifying children.

💰 Claiming your newborn may qualify you for:
• Child Tax Credit
• Additional Child Tax Credit
• Earned Income Credit (if eligible)
• Head of Household (if you qualify)

The new "Trump Accounts" have been introduced to assist children in saving money.👨‍👩‍👧‍👦👨‍👩‍👧‍👦👨‍👩‍👧‍👦 Here is a simple breakdown:

✅️For Babies: If your baby is born between 2025 and 2028, the government will deposit $1,000 into a special savings account for them. It is a "welcome to the world" gift to aid them later in life.

✅️ For All Kids: If your child is under 18, you can open an account for them as well. Even if they do not receive the free $1,000, they can still save money tax-free.

🚨🚨A common misconception surrounds tax claims for qualifying children. 🙃🚨🚨🚨🚨

✅️ IRS rules specify that, in most cases, only one parent can claim the child for major child-based benefits.

✅️ The custodial parent, defined as the parent with whom the child resides for the majority of nights, is typically the claimant. However, if the child spends an equal number of nights with both parents, the IRS employs tiebreaker rules, with the parent having the higher AGI serving as the deciding factor.

✅️ It is essential to recognize that court orders addressing custody and swapping years do not supersede the IRS definitions for tax filing purposes.

✅️When parents are unmarried or living apart and alternate years, the noncustodial parent must attach Form 8332, signed by the custodial parent, to their return to claim the child for the CTC, Additional CTC, or Credit for Other Dependents. Importantly, Form 8332 does not confer eligibility for Head of Household, EITC, or Child and Dependent Care Credit upon the noncustodial parent.
