A Message to Employers:

2020 has brought more than a few challenges to employers. With the passing of the CARES Act on December 27, 2020, some relief was granted to employers receiving Paycheck Protection Program Loans. The Act now allows for the deductibility of expenses paid from PPP Loan proceeds which will greatly help already struggling businesses. PPP Loan proceeds are not taxable income.

The Act also made retroactive changes to the availability of employer tax credits. Prior to the enactment, employers who received PPP Loans were not eligible to claim certain employer tax credits. Now, those employers are eligible for credits, however they cannot use the same wages used to apply for PPP loan forgiveness. With this retroactive change, you will want to review your records to determine if you are eligible to claim the Employee Retention Credit, the Paid Sick/Family Leave Credit or the Employer Payroll Tax Deferral.
