On March 29 the house passed the Secure Act 2.0 making in mandatory to employers to automatically enroll new employees in a 401K savings plan. California already has mandatory retirement savings plan in place, effective June 1 all employers must deduct and remit retirement payments on behalf of their employees. Here is the ruling as stated from SHRM: SECURE Act 2.0 would require employers that establish new defined contribution plans to automatically enroll newly hired employees, when eligible, in the plan at a pretax contribution level of 3 percent of the employee's pay. This level would increase annually by 1 percentage point up to at least 10 percent but not more than 15 percent of the employee's pay. Employees could affirmatively elect a different contribution. This applies to employers with more than 10 employees and or in business more than 3 years.

Eligibility Requirements: (A Business Must Satisfy All Applicable Requirements Per Category)
Requirements for All Businesses

General Requirements • Was fully operational on February 29, 2020.
• Had gross earned revenue during any of the first, second, third, or fourth quarter in 2020 that demonstrated not
less than a 25 percent reduction from the gross earned revenue of such business during the corresponding quarter
in 2019.

Ownership Restrictions • Is not listed on a stock exchange or majority owned and controlled by an entity listed on a stock exchange.
• Does not have, or is not majority owned and controlled by an entity with, all three of the following characteristics:
1.Owns or operates venues, relevant museums, motion picture theatres, or talent agencies or talent management
companies in more than one country;
2.Owns or operates venues, relevant museums, motion picture theatres, or talent agencies or talent management
companies in more than ten States;
and
3.Employs more than 500 employees as of February 29, 2020, determined on a full-time equivalent basis.
• Not majority owned or controlled by an entity that received more than 10% of gross revenue from federal funding
during 2019, excluding amounts received by such business under the Robert T. Stafford Disaster Relief and
Emergency Assistance Act.

Prohibited Activities • Does not (i) present live performances of a prurient sexual nature or (ii) derive, directly or indirectly, more than deminimis gross revenue through the sale of products or services, or the presentation of any depictions or displays, of
a prurient sexual nature.
• Has not received on or after December 27, 2020 any loan under the SBA’s Paycheck Protection Program (PPP),
whether under paragraph (36) (first draw PPP loans) or paragraph (37) (second draw PPP loans) of Section 7(a) of
the Small Business Act).

in the Paycheck Protection Program
Steps to Promote Equitable Relief for Mom-and-Pop Businesses

WASHINGTON – Building on a month of strong results, the Biden-Harris Administration and the U.S. Small Business Administration are taking steps with the Paycheck Protection Program to further promote equitable relief for America’s mom-and-pop businesses.


The latest round of Paycheck Protection Program funding opened one month ago and already the Biden Administration has succeeded in making major improvements to the program’s implementation:

For businesses with fewer than ten employees, the share of funding is up nearly 60%
For businesses in rural communities, the share of funding is up nearly 30%
The share of funding distributed through Community Development Financial Institutions and Minority Depository Institutions is up more than 40%
“The SBA is a frontline agency working to create an inclusive economy, focused on reaching women-owned, minority-owned, low- and moderate-income, rural, and other underserved communities in meaningful ways. While reported data illustrates we have made real strides in ensuring these funds are reaching underserved communities, we believe we can still do better,” says SBA Senior Advisor Michael Roth. “The important policy changes we are announcing further ensure inclusivity and integrity by increasing access and much-needed aid to Main Street businesses that anchor our neighborhoods and help families build wealth.”

2. Loan Forgiveness Process
What is the general process to obtain
loan forgiveness?
To receive loan forgiveness, a
borrower must complete and submit the
Loan Forgiveness Application (SBA
Form 3508 or lender equivalent) to its
lender (or the lender servicing its loan).
As a general matter, the lender will
review the application and make a
decision regarding loan forgiveness. The
lender has 60 days from receipt of a
complete application to issue a decision
to SBA. If the lender determines that the
borrower is entitled to forgiveness of
some or all of the amount applied for
under the statute and applicable
regulations, the lender must request
payment from SBA at the time the
lender issues its decision to SBA. SBA
will, subject to any SBA review of the
loan or loan application, remit the
appropriate forgiveness amount to the
lender, plus any interest accrued
through the date of payment, not later
than 90 days after the lender issues its
decision to SBA.

75% of the PPP monies you received must have been spent on payroll costs. This applies to the 8 week period following the date the funds were received.
I have a copy of the 7 page document received from SBA.

Do not forget to fill out the application - it must be submitted before the deadline.
