Oregon Paid Sick Time Law:
Oregon law requires employers with 10 or more employees (6 or more if located in Portland) to provide paid, protected sick time, accruing at 1 hour per 30 hours worked, up to 40 hours per year. Employees can use accrued time after 90 days of employment for illness, injury, or family care, with unused time carrying over up to 40 hours.
Eligibility: Nearly all employees in Oregon are covered, including part-time and temporary workers.
Accrual Rate: Employees earn 1 hour of protected sick time for every 30 hours worked, starting on their first day. Maximum Accrual/Usage: Employers can cap annual usage and accrual at 40 hours per year.
Paid vs. Unpaid: If an employer has 10+ employees (6+ in Portland), the time must be paid. Otherwise, it is protected but unpaid.
Frontloading Option: Instead of accrual, employers may choose to frontload at least 40 hours of sick time at the start of the year.
Usage Timing: Employees can begin using accrued sick time after 90 days of employment.
Carryover: Employees can carry over up to 40 hours of unused sick time from one year to the next.
Permitted Uses: Sick time covers personal illness/injury, care of family members, mental health needs, parental leave, bereavement, and legal matters related to domestic violence or harassment.
Documentation: Employers can require verification of sick time usage if the employee is absent for more than 3 consecutive days.
