Wiltshire, Whitley, Richardson & English, P.A. (WWRE) is pleased to announce that Jason T. Smith, CPA, has been admitted as a shareholder of the firm, effective January 2026.

Jason has been a valued member of WWRE since joining the firm as a senior accountant in 2019. He was promoted to manager in 2021 and has played an integral role in the firm’s continued growth and client success. As a shareholder, Jason will continue to be involved in all areas of the firm’s practice, including accounting, auditing, and tax planning and preparation, serving both business and individual clients.

In addition to his new role as shareholder, Jason serves as a member of the Board of Directors of Wiltshire, Whitley, Richardson & English, P.A.

Jason has lived in Southwest Florida since 2019. He earned his Bachelor of Arts from Western Michigan University and his Master of Business Administration from Baker College. He has been a licensed Certified Public Accountant since 2017 and is an active member of both the American Institute of Certified Public Accountants and the Florida Institute of Certified Public Accountants.

IRS Announces Tax Relief for Those Impacted by Idalia in Florida

The IRS has announced tax relief for individuals and businesses located in certain Florida counties that were impacted by the storm that began on August 27, 2023. Lee County is one of the counties listed as affected by Hurricane Idalia. Follow this link for a complete list of counties and additional information.

Please note that since our firm is located in Lee County, the extension includes any of our clients, regardless of the county in which you reside. What this means for our clients is that most deadlines falling after August 27, 2023, and before February 15, 2024, are now extended until February 15, 2024. This is NOT an extension of time to pay any taxes that may be due for the 2022 tax year. Those taxes were due by April 15, 2023, regardless of your extension, and will continue to accrue late-payment penalties and interest until paid. However, it does extend the time to FILE business and partnership returns that were due 9/15, trusts that were due 10/2, and individual returns that were due 10/16.

Quarterly estimated payments after August 27, 2023, are also extended until February 15, 2024.

Penalties on payroll and excise tax deposits due on or after August 27, 2023, and before September 11, 2023, will be abated as long as the tax deposits are made by September 11, 2023.

Hurricane Ian – Qualified Disaster Losses

President Biden has issued a federal disaster area declaration for the State of Florida. Hurricane Ian has been assigned a FEMA disaster area number of DR-4673-FL. As a federally declared disaster, there are certain favorable modifications to the general casualty loss rules.

If you have experienced damage from the storm, you have the option of reporting qualified disaster area losses on your individual tax return for either the 2022 or the 2021 tax year. It may be possible to receive an expedited refund by claiming the loss on your 2021 return as the IRS processes amended returns with the appropriate disaster information more quickly. If you choose the 2021 tax year, an amended 2021 return (1040-X) is required if you have already filed your 2021 return.

Generally, a casualty loss is the lesser of your adjusted basis in the destroyed property and the reduction in the fair market value from before and after the storm. However, there are several safe harbor methods available in the case of a federal declared disaster. These include the contractor safe harbor, the disaster loan appraisal, and the replacement cost safe harbor. Once the loss is determined, it must be netted with insurance proceeds received or expected to be received. Because Hurricane Ian is a qualified disaster loss, the AGI limitations do not apply, and the loss is reduced by a $500 floor. You do not need to itemize to declare this loss.

HURRICANES AND TAXES



First and foremost, we hope and pray that all of you and your families are safe.

If you need assistance, you can call 211 to be directed to who can help you. You can also apply for financial assistance from FEMA. FEMA offers assistance for damage and losses not covered by homeowners, renters or flood insurance as well as other disaster related expenses such as temporary housing, medical bills, and moving and storage. You can apply for assistance directly online by going to fema.gov and click the button to apply for assistance.



For the WWRE family, some of our employees have severe damage and will be displaced for some time, some have major damage, but homes are livable, and some came through fairly well. We all are in various stages of recovery from this horrific hurricane. Our community is badly damaged, but we will rebuild.



The physical office is undamaged but for some downed trees. However, we currently do not have power. That means our communications, servers, everything is down right now. Tax return deadlines have been postponed (see below), but in the meantime if you need to contact one of the partners, the best way is probably through email. Most of us have some cell service and limited access to email. We will respond just as quickly as we can.



IRS has announced that victims of Hurricane Ian, including businesses and where your tax records are located, are eligible for disaster relief. Most deadlines falling on or after September 23, 2022 and before February 15, 2023, are postponed through February 15, 2023.



Trusts that have a valid extension through September 30th and individuals who have a valid extension through October 17th, are now due on February 15, 2023. However, this is not an extension of time to pay, as the estimated balance of tax was due with the extensions filed earlier in the year.



Estimated payments due October 17, 2022 and January 15, 2023 are extended to February 15, 2023.



Quarterly payroll returns due October 31, 2022 and January 31, 2023 are also extended to February 15, 2023. However, payroll tax deposits still have to be timely paid. Penalties on payroll and excise deposits due on or after September 23, 2022 and before October 10, 2022 will be waived if paid by October 10, 2022.

Hurricane Ian will undoubtedly have some effect on SW Florida. We will likely lose power for an extended period of time. In anticipation of this, we have decided to close our office on Tuesday and Wednesday, at a minimum. As soon as we have power, and can get our office staffed and back up and running, we will reopen.

For anyone in the path of Ian, be careful and stay safe.
