In addition to our hearts, thoughts, and prayers going out to the victims of Hurricane Harvey (with Irma lingering in the Atlantic); the importance of preparing for a natural disaster seems more important now more than ever. One very important step in this process is the securing of your important financial records and data - which should include information needed to file both business and personal taxes. The ugly truth, however, is that although the IRS normally postpones the filing of tax returns, at some point, they will need to be filed. It’s not uncommon to feel overwhelmed when you haven’t filed for a while, but don’t despair. Many people become non-filers each year for a number of reasons. On this 4th of July weekend, we're all looking to get away for a long holiday weekend. But for some, it may be anything BUT a vacation. On December 4, 2015, the Fixing America’s Surface Transportation Act, or "FAST Act," became law. The law allows the State Department to confiscate passports for 90 days from "delinquent" taxpayers while they become IRS compliant. How "delinquent"? The law defines this as "an unpaid, legally enforceable federal tax liability" greater than $50,000, including interest and penalties. (This represents a cumulative amount owed to the Government for any/all taxes). If you find yourself in this situation, or have unfiled tax returns we are here to help! ACA Executive Order and Current Tax Filing Season - The Affordable Care Act has traditionally required taxpayers to indicate on Form 1040 whether they had health insurance, an exemption from coverage or made a shared responsibility payment. Due to President Trump's recent Executive Order directing federal agencies to exercise authority and discretion available to them to reduce potential burden of the Affordable Care Act; the IRS has decided to make changes that would continue to allow electronic and paper returns to be accepted for processing in instances where a taxpayer doesn’t indicate their coverage status. Processing these "silent" returns means that these returns will not be automatically rejected by the IRS at the time of filing. This allows the returns to be processed and minimizes the burden on taxpayers; especially those expecting a refund. However, legislative provisions of the ACA law are still in force until changed by the Congress, and taxpayers remain required to follow the law and pay what they may owe‎.

Note: The IRS was required by the Path Act of 2015 to delay the processing of certain tax return refunds (those claiming either the Earned Income Tax Credit (EITC) and/or the Additional Child Tax Credit (ACTC) until Wed., Feb 15th, 2017.
