Please make sure and keep the letter you receive a few weeks after you receive your check so you can recalculate any remaining adoption tax credit carry forward you may still have!!!

IR-2026-123, Oct. 16, 2026 — The Internal Revenue Service has already begun issuing refunds to more than 50,000 taxpayers who benefited from the adoption tax credit carryforward and expects the refund process for most eligible taxpayers to be complete by the end of the year.

In 2018, a middle-school math teacher in Colorado named Finn Lanning learned that one of his students, 13-year-old Damien, was facing a terrible situation. Damien had serious kidney disease and desperately needed a transplant. But he also needed a stable home.

Because his medical needs were difficult to manage, he had moved between foster homes and sometimes had to live in a hospital. Without a stable place to recover after surgery, he had been taken off the kidney transplant waiting list.

Finn had never planned on becoming a parent. But he couldn’t simply walk away. He trained to handle Damien’s medical needs, including his intensive dialysis, and became his foster father. Once Damien had a stable home, he returned to the transplant list.

Then, in June 2019, he received a new kidney. But Finn’s commitment didn’t end with the surgery. He kept caring for Damien and helped him through recovery. And their story had one more happy ending. In March 2021, Finn officially adopted Damien.

The boy who once feared that another foster home might not last finally had a permanent family. He gained a new kidney and a father who told him he wasn’t going anywhere.

GREAT NEWS!!!!

The IRS has finally implemented the change in the OBBB on who gets part of their adoption tax credit as a partial refundable credit.

It was originally written that only $5,000 of the adoption tax credit refundable portion was for adoptions finalized after Dec. 31, 2024.

However, after much advocating back in March, Congress decided that families with an Adoption Tax Credit carry forward could also take part in the partial refundability of their carry forward! We have just been waiting for the IRS to implement it on their end.

Many adoptive families are receiving a direct deposit plus interest from the IRS! Woot Woot!

Please keep the letter from the IRS that you will receive so you can adjust the correct carry forward amount come tax time!!!
