📚 Sometimes the IRS problem is actually a bookkeeping problem first.

Here is a very real situation we see:

A business owner has not filed tax returns for three years.

They come to me because the IRS is becoming a problem.

Great.

We need to get those returns filed.

Except... 👀

Nobody really knows what the business made.

❌ Bank accounts have not been reconciled
❌ Business and personal expenses are mixed together
❌ Deposits are sitting in the wrong places
❌ Loans may have been recorded as income
❌ Credit cards have not been properly categorized
❌ QuickBooks exists but the Profit and Loss cannot be trusted

Now the IRS resolution case has another step.

We may need to:

🔎 Reconstruct the books
📊 Determine the actual income and expenses
📂 Prepare the missing returns
💵 Find out what the REAL tax liability is

And only THEN determine the best IRS resolution. 🧭

That is why I say this all the time:

You cannot build a good tax resolution strategy on bad financial information.

Sometimes you have to rebuild the financial story before you can fix the tax story. ✨

🚨 Owing the IRS a lot of money does NOT automatically mean you qualify for an Offer in Compromise.

This is probably the biggest misconception I see.

Someone owes $100,000.

They have seen the commercials.

They ask:

"Can you settle it for $10,000?"

Maybe.

Maybe not. 👀

The amount you owe is only one piece of the analysis.

When I evaluate an Offer in Compromise I am looking at:

💵 Income
🏠 Allowable living expenses
💰 Cash and investments
🚗 Vehicles
🏡 Real estate equity
🏢 Business assets
📊 Future ability to pay
📂 Filing compliance
⏰ Current estimated taxes

Sometimes an OIC is absolutely the right move.

Sometimes pursuing one would waste months and money when another resolution makes much more sense.

That might be:

🔹 An installment agreement
🔹 Currently Not Collectible status
🔹 Penalty relief
🔹 Fixing an incorrect tax assessment
🔹 An appeal
🔹 Another collection strategy

My job is not to sell someone an Offer in Compromise.

My job is to figure out which resolution actually fits the facts.

Big difference. ✨

🧾 Someone calls me and says: "The IRS says I owe $42,000."

Okay.

That tells me something.

But not nearly enough. 👀

I want to know:

📅 What years?
📂 Are all returns filed?
💵 What caused the balance?
📊 How much is tax versus penalties and interest?
🏦 Has the IRS started collection activity?
🔒 Is there a lien?
⚠️ A levy warning?
⏰ An appeal deadline?
📋 Did the IRS prepare a return because the taxpayer never filed one?
✅ Are estimated taxes current NOW?

Because here is what happens all the time:

The problem the taxpayer knows about is only PART of the problem.

That is why one of the first things I do in a representation case is pull and analyze the IRS transcripts.

I want the full picture.

Not somebody's best recollection.
Not one notice.
Not the balance showing on one screen.

Tax resolution is strategy. 🧭

And strategy built on incomplete information is usually bad strategy.

🧭 Most people know what a tax preparer does. Tax representation? That gets fuzzy.

Here is the simplest way I explain it:

When the IRS problem gets bigger than preparing a tax return...

That is where I come in.

I figure out what the IRS has on record.

I look at:

📄 Notices
📊 Transcripts
💵 Balances
📂 Missing returns
⚠️ Penalties
⏰ Collection activity

I identify deadlines that matter.

I determine what needs to be fixed BEFORE we ever start talking about resolution.

And when appropriate, I communicate and negotiate with the IRS on my client's behalf.

Because tax representation is NOT:

❌ "Call the IRS and ask for a payment plan."

It is figuring out:

🔎 What happened?
🔎 What does the IRS think happened?
🔎 What rights and options does the taxpayer have?
🔎 What is the smartest path from here?

Sometimes the answer is an installment agreement.
Sometimes it is an Offer in Compromise.
Sometimes it is Currently Not Collectible status.
Sometimes it is penalty relief.
Sometimes we discover the real problem is unfiled returns or financial records that have to be reconstructed first.

The resolution comes AFTER the diagnosis.

That is the part those "settle your IRS debt for pennies on the dollar" commercials tend to leave out. 🧾

❤️ SOMETIMES THE FIRST THING A TAXPAYER DOES WHEN THEY CALL JEN IS CRY.

They’re scared.

They have an IRS letter they don’t understand. They’ve heard horror stories. They don’t know what the IRS can actually do.

And sometimes they’ve spent days, weeks or months imagining the absolute worst.

Jen can’t tell you how many times she’s heard:

“But the IRS CAN’T do that!”

Or:

“They shouldn’t be allowed to do that!”

And sometimes the answer really is:

“I understand why that sounds crazy. But yes, the IRS actually can.”

Other times, the thing keeping someone awake at night isn’t actually what’s happening at all.

That’s why understanding the facts matters.

Even being selected for an IRS audit does not automatically mean the IRS believes you cheated or did something dishonest.

The tax problem usually doesn’t disappear during that first conversation.

But something important often DOES change.

We hear:

Tax strategy is not your tax professional waving a magic deduction wand on December 29. 🪄

Before we can make intelligent tax decisions, we need to know what is actually happening in the business.

📚 How profitable is the business REALLY?

💰 How much has the owner actually taken out?

🏦 Are the bank and credit-card accounts reconciled?

💵 Are estimated tax payments on track?

👥 Is the owner paying themselves correctly?

📈 What can still be changed BEFORE year-end?

Here’s something business owners sometimes learn the hard way:

Good bookkeeping isn’t only about taxes. It keeps your business READY.

Remember PPP and EIDL during COVID?

Businesses that already had current books, payroll information and financial records were in a much better position to quickly pull together what they needed instead of reconstructing months of information during an emergency.

The same thing happens when:

🏦 A bank asks for current financial statements for a loan or line of credit.
🚚 You need financing for equipment or expansion.
💵 You’re applying for funding or talking with an investor.
🔎 The IRS asks you to substantiate something.
🤝 You’re considering selling the business or bringing in a partner.
📊 You need to make a major decision and know whether the business can actually afford it.

Opportunities don’t always wait six months for someone to clean up your books.
Good bookkeeping isn’t the tax strategy.

It’s the information good tax strategy AND good business decisions are built on.

⏰ ONE OF THE MOST EXPENSIVE TAX MISUNDERSTANDINGS:

“I filed an extension, so I got more time to pay too.”
NOPE.

A tax extension gives you additional time to FILE.

It generally does NOT give you additional time to PAY tax that was already due.

And business owners have another important date coming:
📅 SEPTEMBER 15

Calendar-year S corporations and partnerships that timely extended their 2025 returns generally have until September 15 to file.

September 15 is also the third 2026 estimated-tax payment date for individuals.

And here’s a number that may get your attention:

A late 2025 S corporation return with NO TAX DUE can still face a penalty of:

💸 $255 PER SHAREHOLDER, PER MONTH or part of a month, for up to 12 months.

Two shareholders.

One month late.

$510.

Even though the corporation itself may have had no income tax due.

👻 TAX NIGHTMARE MONDAY: THE PHANTOM TAX FILING

Here’s an IRS nightmare most people don’t even know exists.

Someone hasn’t filed tax returns for a few years.

Maybe life happened. Records were lost. Their tax preparer disappeared, retired or even passed away.

Maybe they became overwhelmed, frightened and just kept putting it off.

Then they discover something shocking:

😳 THE IRS ESSENTIALLY FILED A TAX RETURN FOR THEM.

It’s called a Substitute for Return, or SFR.

Around here, we sometimes call it a “phantom tax filing.” 👻

And here’s where it can turn into a nightmare:

The IRS is working from information available to them. Their version may not include deductions, credits and other tax benefits the taxpayer could have claimed on a properly prepared return.

That’s when we hear:

😳 “HOW can the IRS say I owe THAT much?”

Then the detective work begins. 🔎

What did the IRS actually do? What income was reported? What records can still be recovered? Do years of bookkeeping need to be reconstructed?

Then we work on getting the taxpayer back to reality instead of leaving them trapped in the phantom version.
