Beginning January 3, 2022, applications for recognition of exemption on Form 1024 must be submitted electronically online at Pay.gov. The IRS will provide a 90-day grace period during which it will continue to accept paper versions of Form 1024 (Rev. 01-2018) and letter applications.
The required user fee for Form 1024 will remain $600 for 2022. Applicants must pay the fee through Pay.gov when submitting the form. Payment can be made directly from a bank account or by credit or debit card.

The passage of Ohio Senate Bill 102, when effective on March 23, 2022, will now allow charitable and political organizations as defined in the bill, to auction off or give away beer and intoxicating liquor as part of a fundraiser without a temporary liquor permit. Prior to the passage of this legislation only beer, wine and mixed drinks could be auctioned off or given away as part of a fundraiser and only with the proper valid temporary liquor permit. All beer, wine and mixed beverages must be purchased from an existing permit holder under Chapter 4303 and any spirituous liquor from a state agency store. If the alcohol is donated for purposes of the fundraiser, the donor must provide the charity or political organization with receipts showing such alcohol was purchased from approved sources. The Division of Liquor Control is developing procedures that will require the charitable or political organization submit evidence that such alcohol was purchased from approved sources.

Ohio Budget bill makes major changes to bingo for veteran, fraternal and sporting organizations. One notable change includes allowing electronic instant bingo or e-bingo for qualifying organizations. The Charitable Law Section of the Ohio Attorney General will be developing the administrative rules that govern this type of bingo. There is no provision to allow 501(C)(3) organizations to participate in this change.

The Internal Revenue Service has issued additional guidance on the Employee Retention Tax Credit on issues that apply to 2020 and 2021. This additional guidance is provided in Notice 2021-49 and supplements prior issued notices on the credit.

At the end of last year, the Consolidated Appropriations Act (CCA) both extended and increased the 2020 Cares Act deduction for those individual taxpayers who don’t itemize and instead take the standard deduction. For 2021, the deduction remains at $300 for single taxpayers but increases to $600 for married filing joint taxpayers. Even though individual giving was generally up in 2020 despite the pandemic, the hope is this continues to provide an incentive to give for those taxpayers.
