The Federal Constitutional Court has declared 𝐒𝐞𝐜𝐭𝐢𝐨𝐧 𝟕𝐄 of the Income Tax Ordinance null and void, striking down a controversial tax provision imposed on immovable properties.

🌟 𝟏. 𝐓𝐡𝐞 "𝐁𝐢𝐠 𝐓𝐡𝐫𝐞𝐞" 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧𝐬
Most individual investors can bypass 7E entirely by qualifying for one of these:
𝐓𝐡𝐞 𝟐𝟓 𝐌𝐢𝐥𝐥𝐢𝐨𝐧 𝐒𝐡𝐢𝐞𝐥𝐝: If the total value of your taxable properties 𝐮𝐧𝐝𝐞𝐫 𝐏𝐊𝐑 𝟐𝟓 𝐦𝐢𝐥𝐥𝐢𝐨𝐧, you owe 0.
𝐓𝐡𝐞 "𝐎𝐧𝐞 𝐇𝐨𝐦𝐞" 𝐑𝐮𝐥𝐞: Your primary residence (one self-owned property) is 𝟏𝟎𝟎% 𝐞𝐱𝐞𝐦𝐩𝐭, regardless of its market value.
𝐀𝐜𝐭𝐢𝐯𝐞 𝐁𝐮𝐬𝐢𝐧𝐞𝐬𝐬 𝐏𝐫𝐞𝐦𝐢𝐬𝐞𝐬: If you use the property for your own business or it is registered agricultural land, it is generally excluded from the 7E net.

The Federal Tax Ombudsman (FTO) and various High Courts have recently addressed "discriminatory" applications of 7E.
𝐂𝐨𝐮𝐫𝐭 𝐒𝐭𝐚𝐲𝐬: Many taxpayers in specific jurisdictions (notably parts of Punjab and KPK) have seen relief through interim court stays, arguing that taxing "unrealized income" is unconstitutional.
𝐑𝐞𝐟𝐮𝐧𝐝 𝐂𝐥𝐚𝐮𝐬𝐞𝐬: If you paid 7E but are later cleared by an appeal or a court ruling, new procedural shifts are making the 𝐫𝐞𝐟𝐮𝐧𝐝 𝐩𝐫𝐨𝐜𝐞𝐬𝐬 more transparent than in previous years.

📄 𝟑. 𝐏𝐫𝐨𝐜𝐞𝐝𝐮𝐫𝐚𝐥 𝐑𝐞𝐥𝐢𝐞𝐟 𝐟𝐨𝐫 𝐅𝐢𝐥𝐞𝐫𝐬
The FBR has streamlined the filing process for the 2025–26 tax year:
𝐍𝐨 𝐒𝐞𝐩𝐚𝐫𝐚𝐭𝐞 𝐂𝐞𝐫𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐞 𝐍𝐞𝐞𝐝𝐞𝐝: For many "𝐀𝐜𝐭𝐢𝐯𝐞 𝐓𝐚𝐱𝐩𝐚𝐲𝐞𝐫𝐬," the system now auto-calculates exemptions, removing the need to chase manual "7E Discharge Certificates" for every transaction.
𝐎𝐯𝐞𝐫𝐬𝐞𝐚𝐬 𝐑𝐞𝐥𝐢𝐞𝐟: Non-resident Pakistanis (NICOP holders) who do not own taxable property in Pakistan are increasingly being shielded from the filing "red tape" during property transfers.

💡 𝐏𝐫𝐨-𝐓𝐢𝐩 𝐟𝐨𝐫 𝐏𝐫𝐨𝐩𝐞𝐫𝐭𝐲 𝐎𝐰𝐧𝐞𝐫𝐬
If you are selling a property, ensure your 𝐒𝐞𝐜𝐭𝐢𝐨𝐧 𝟕𝐄 is correctly reflected in the IRIS portal. Even if you are exempt, failing to "declare" the exemption can stall your sale at the 𝐑𝐞𝐠𝐢𝐬𝐭𝐫𝐚𝐫'𝐬 𝐨𝐟𝐟𝐢𝐜𝐞.
