🇲🇾在马来西亚的遗嘱分配法并非全国统一。西马和砂拉越是根据Distribution Act 1958 (Revised 1983)而沙巴州则是用Intestate Succession Ordinance 1960。😧这两个条律的分配法有少许不同，但法律流程基本上大同小异的。所有遗产还是会被冻结，都是需要执行人/管理人跟法院申请Grant of Probate(GP) 或 Letter of Administration (LA)。

相信你们对TVB剧溏心风暴、家族荣耀等电视剧不陌生吧！你以为只有那些富有人家临终前才立遗嘱。但事实上，立遗嘱并不只是有钱人的事情。

🤔那到底谁需要立遗嘱呢？不立遗嘱会怎么样分配呢？
✅只要你年满18岁并且拥有至少一项财产(saving account/ car/ properties/ shares/ gold/ unit trust, etc)
✅无论财产多少，都应该需要立遗嘱。不然就像以上的案例一样，自己辛辛苦苦赚来的财富去到不想给的人手中，甚至最后的最后有可能归政府😈

🛑许多人认为自己没有多少财产，没有必要立遗嘱。又或者觉得很贵很麻烦，一拖再拖结果最后把所有的麻烦和债务留给我们的至亲至爱。谁说死亡只是老人家的专利？人生很无常，你身边可能也遇见过同龄的朋友甚至比自己年轻的亲人突然离世。如果意外真的先来我们被逼离去，至少我们能确保他们的生活安排妥当，这是对家人的责任，避免留下未解的麻烦。家人除了要面对至亲的离开，还要去烦一大堆的法律程序和费用，还有一大堆的债务，这绝对不是你想要的对吧。

对于一个普通家庭，最基本的债务和负担包括：
💸房贷
💸车贷
💸信用卡债务
💸银行贷款
💸每个月的家庭生活开肖
💸子女教育费用
💸父母赡养费
🤔这些债务该如何应对呢？这还没包括遗产执行的律师费，房产车子的割名费，Stamp Duty，Cukai等等…单靠银行saving account, FD和EPF可以让家人tahan多久？因此，一个完整的遗产规划必须覆盖到Funding Calculation的这一块来精准的计算出需要多少费用，在利用Life Insurance来以最小的资金帮你解决到这些很现实又庞大的的债务问题！！

🆘很重要所以必须重复3次！只有EPF和人寿保险的资金可以在短时间内直接发放给受益人，是creditor proof,而且不需要被抽税的。🆘前提是必需指定好正确的受益人，不然没有受益人的话就会当作是普通遗产，和其他遗产种类一样必须被冻结，然后还是要通过很长时间和繁杂的法律流程

总结来说：
🖋️设立遗嘱：你可以指定遗产执行人和安排未成年小孩的监护人。
📃 配合设立信托：信托公司将作为遗产管理人，负责处理所有遗产和更细腻的分配财产，更好的保护不善管理钱财的受益人比如未成年小孩、家庭主妇等。
❌没有立遗嘱和信托：逝者的亲属需要决定遗产管理人，并向高等法院申请遗产管理状然后依据马来西亚分配法来分配。
