The Inland Revenue Authority of Singapore (IRAS) published the IRAS e-Tax Guide Transfer Pricing Guidelines, Sixth Edition on 10 August 2021, strengthening the supervision of transfer pricing. The Guidelines cover the application of the arm’s length principle in related party transactions, requirements for the preparation of contemporaneous data, advance pricing agreements, etc. Taxpayers involved in transfer pricing and meeting the disclosure standards prescribed by the Guidelines are required to prepare Transfer Pricing Documentation before filing tax returns for each tax year.

Penalty for Non-Compliance with Transfer Pricing Documentation Requirements
Effective from YA 2019, a taxpayer is liable to a fine not exceeding $10,000 if it commits the following offences:
1. Failure to prepare transfer pricing documentation in accordance with the prescribed timing or content.
2. Failure to submit transfer pricing documentation within 30 days of a request by IRAS;
3. Failure to retain transfer pricing documentation for at least 5 years; or
4. Provision of any documentation that is false or misleading
