SST on rental services reduced from 8% to 6%

MSMEs with turnover below RM1.5mil are fully exempted

Government estimates revenue loss of RM500 million annually to help businesses

๐Ÿ“œ Stamp Duty

Voluntary Stamp Duty Disclosure Programme extended for another 6 months

New period: 1 Jan โ€“ 30 June

๐Ÿ’ฐ Income Tax Refunds

RM22.5 billion income tax refunds already paid

3.5 million backlog cases resolved last year

Target:

YA 2023: settle by Q1

YA 2024: settle by end of the year

Government acknowledges delays seriously affect SME cash flow

๐ŸŒพ Agriculture Sector

Tax exemptions for animal feed, fertiliser & insecticide manufacturers will be limited

Aim: reduce agricultural production costs

๐Ÿ“Œ The Prime Minister stressed that the government is listening to public and SME concerns, especially where delayed refunds and compliance costs affect survival and cash flow.

Artificial Intelligence (AI) is transforming how organizations work โ€” from chatbots and dashboards to generative AI tool...
22/12/2025

Artificial Intelligence (AI) is transforming how organizations work โ€” from chatbots and dashboards to generative AI tools that boost speed and productivity. But thereโ€™s a growing concern many businesses overlook: Shadow AI.

๐Ÿ” What is Shadow AI?
Shadow AI happens when employees use AI tools without approval from IT, security, or compliance teams โ€” similar to the old problem of shadow IT. While it may improve short-term productivity, it creates serious long-term risks.

โš ๏ธ Why is Shadow AI dangerous?
โ€ข Data leakage & IP exposure โ€“ confidential company data may be shared unknowingly
โ€ข Compliance violations โ€“ AI tools may breach laws and frameworks like NIST AI RMF or the EU AI Act
โ€ข Cybersecurity threats โ€“ unapproved tools can introduce malware or backdoors
โ€ข AI hallucinations & bias โ€“ unreliable outputs lead to poor decisions

๐Ÿ“‰ Studies show that while 26% of organizations invest in AI, only 4% achieve meaningful ROI, largely due to risks and inefficiencies caused by uncontrolled Shadow AI usage.

โœ… So, what should organizations do?
โœ” Conduct AI usage audits to detect unauthorized tools
โœ” Establish clear AI policies and governance frameworks
โœ” Control access using identity & access management (IAM)
โœ” Train employees on ethical and responsible AI use
โœ” Integrate AI risks into Enterprise Risk Management (ERM)

๐Ÿงญ The takeaway
AI can deliver massive value โ€” but only if used responsibly. Without governance, Shadow AI exposes organizations to security breaches, legal penalties, and reputational damage.

๐Ÿ’ก A strong AI governance roadmap, regular audits, and employee awareness are key to unlocking AIโ€™s full potential โ€” safely and sustainably.

๐Ÿ‘‰ Does your organization have control over how AI is being used today?

๐Ÿ“ข Good News for SMEs & Small Business Owners!

The government has announced that the e-Invoicing exemption threshold will be increased from RM500,000 to RM1 MILLION starting in 2026 ๐ŸŽ‰

Prime Minister Anwar Ibrahim said the decision was made after listening directly to feedback from small business owners who are concerned about the cost and pressure of implementing e-Invoicing.

๐Ÿ‘‰ What does this mean?
โœ… Small businesses with annual turnover below RM1 million will NOT be required to implement e-Invoicing
โœ… Lower compliance costs for SMEs
โœ… A more realistic and orderly rollout of the e-Invoicing system

The Prime Minister also acknowledged public frustration over delayed tax refunds, especially among taxpayers who file and pay on time.

๐Ÿ’ฐ Immediate action by the government:
๐Ÿ”น Tax refund allocation increased from RM2 billion to RM4 billion in December 2025
๐Ÿ”น Faster refunds, with priority given to small businesses

This announcement was made during the Sentuhan Madani Bersama Rakyat Sabah program at Sabah International Convention Centre.

๐Ÿ‘ A positive move that shows the government is listening and supporting SMEs.

๐Ÿšจ Delayed Tax Refunds Are Hurting Malaysian Businesses ๐Ÿšจ

Many businesses in Malaysia are facing years of delay in getting their tax refunds from LHDN โ€” and itโ€™s causing serious cash flow problems.

๐Ÿ’ธ Why is this a big issue?
When refunds are delayed:

Businesses struggle to pay staff & suppliers

Expansion plans get postponed

Some companies are forced to take high-interest loans just to survive

Tax experts warn this also reduces trust in the tax system and makes financial planning unpredictable.

๐Ÿ“Œ What businesses can do to speed up refunds:
โœ… Use e-Filing (refunds usually within 30 days vs 90 days manual)
โœ… Ensure all documents are complete & accurate
โœ… Keep bank details updated in LHDN system
โœ… Monitor refund status via LHDN online portal
โœ… Submit a formal follow-up letter if refunds are delayed

โš–๏ธ Did you know?
Under Section 111D of the Income Tax Act 1967, businesses are entitled to 2% annual compensation if refunds are delayed (and the delay is not the taxpayerโ€™s fault).

โณ Refunds are considered late if:

More than 90 days (e-Filing)

More than 120 days (manual filing)

๐Ÿ›๏ธ Government response:

RM4 billion allocated in 2025 to clear refund backlogs

โ€œFirst-in, first-outโ€ approach to process refunds faster

๐Ÿ“Š How to avoid overpaying tax in the first place:
1๏ธโƒฃ Estimate tax carefully (aim at least 85% accuracy)
2๏ธโƒฃ Revise CP204 estimates in Month 6, 9 & 11
3๏ธโƒฃ Avoid overpaying โ€œjust in caseโ€ โ€” excess tax earns zero interest
4๏ธโƒฃ Consult a tax professional for better planning

๐Ÿ“ฃ Some businesses claim refunds only came after 4 years โ€” while underpayments are flagged quickly.

๐Ÿ‘‰ Your money matters. Stay proactive, stay informed, and protect your business cash flow.

25/11/2025

๐Ÿงพ Understanding CP204 (Estimated Tax) โ€” Simple Guide for Malaysian Businesses

If youโ€™re running a company, LLP, trust, or cooperative in Malaysia, you MUST submit your Estimated Tax Payable (CP204) every year. Hereโ€™s a simple breakdown so everyone can understand ๐Ÿ‘‡

โœ… What is CP204?

CP204 is a form where businesses tell LHDN how much tax they expect to pay for the coming year.
You will then pay this tax every month through instalments.

๐Ÿ“จ How to Submit CP204?

All businesses must submit online (e-Filing):

Companies โ†’ e-Filing required since YA 2018

LLPs, trusts & cooperatives โ†’ e-Filing required since YA 2019

You must use a digital certificate through:

TAeF โ€“ for tax agents

OeF โ€“ for company directors

๐Ÿ“… When Must CP204 Be Submitted?
๐Ÿ”น If your business is already operating:

Submit 30 days BEFORE the new financial year begins.

Example:
If your companyโ€™s next basis period starts 1 Jan, submit by 1 Dec of the previous year.

๐Ÿ”น If your business is NEW (first basis period โ‰ฅ 6 months):

Submit within 3 months from the date you start operations.

โœ” Applies only for the first year
โœ” Starting second year โ†’ follow the โ€œ30 days before basis periodโ€ rule

Example:

Business starts: 3 April 2021

First year-end: 31 Dec 2021 (9 months)

MUST submit CP204 by 30 June 2021

๐Ÿ’ฐ When Do Monthly Tax Payments Start?
๐Ÿ”น Existing business:

Starts in the 2nd month of your financial year.

๐Ÿ”น New business:

Starts in the 6th month after your business begins.

Payments are made every month, due on the 15th.

๐Ÿ“‰ Minimum Estimated Tax Rule

Starting from 2nd year onward, your estimated tax cannot be less than 85% of last yearโ€™s estimated tax.

For new companies, you estimate based on projected profit.

๐Ÿ›  Can You Change Your Estimated Tax? (CP204A)

Yes! You can revise in:

6th month

9th month

11th month

LHDN will adjust your remaining instalments accordingly.

โš ๏ธ If You Do NOT Submit CP204:

LHDN will:

Issue CP205 (LHDN will estimate tax for you)

You may face a fine RM200โ€“RM20,000, jail up to 6 months, or both

๐Ÿ“Œ In Short:

CP204 = your estimated tax

Submit early (new: within 3 months; existing: 30 days before year starts)

Pay monthly by 15th

You can revise estimate

Donโ€™t ignore CP204!

The Malaysian Semiconductor Ecosystem: A Transfer Pricing Perspective

๐ŸŒ Malaysiaโ€™s Big Move into the Semiconductor World

Malaysia is on a mission to become a global semiconductor hub under the New Industrial Master Plan (NIMP) 2030 โ€” aiming to attract high-tech investments and move up the semiconductor value chain.

But as more multinational companies (MNCs) invest here, theyโ€™ll need to carefully balance between tax compliance (TP Rules, MTPG 2024) and their business strategies.

๐Ÿ’ก What is a Semiconductor?

Semiconductors โ€” also known as microchips or ICs (integrated circuits) โ€” are the brains inside almost every electronic device around you:
๐Ÿ“ฑ Smartphones
๐Ÿš— Cars and electric vehicles
โš™๏ธ Medical equipment
๐ŸŒž Solar energy systems
๐Ÿ–ฅ๏ธ Computers and AI servers

They control data, process signals, and power the digital world we live in. Without semiconductors, modern life simply wouldnโ€™t function.

๐ŸŒ Global Demand is Rising Fast

The worldโ€™s demand for semiconductors is exploding due to:
๐Ÿค– Artificial Intelligence (AI) โ€“ advanced chips power AI models and data centres.
๐Ÿš˜ Electric Vehicles (EVs) โ€“ chips manage batteries, power systems, and sensors.
๐ŸŒž Renewable Energy โ€“ semiconductors control energy storage and conversion.
๐ŸŒ Internet of Things (IoT) โ€“ from smart homes to factories, everything needs chips.

๐Ÿ‡ฒ๐Ÿ‡พ Malaysiaโ€™s Strength in the Industry

Malaysia has been a key semiconductor player for decades, especially in assembly and testing (OSAT) โ€” contributing 13% of the global market and ranking 6th among global exporters.

Now, with support from Budget 2025, Malaysia aims to:
๐Ÿ”น Strengthen local supply chains (Supply Chain Resilience Initiative)
๐Ÿ”น Attract high-value investments (New Investment Incentive Framework)
๐Ÿ”น Expand tax incentives to include IC design โ€” not just manufacturing

These steps will help Malaysia move beyond assembly to design and innovation, boosting our role in the global semiconductor ecosystem.

โš™๏ธ Transfer Pricing in Malaysiaโ€™s Semiconductor Industry

Why does it matter?

Malaysiaโ€™s strong semiconductor ecosystem has made it one of the top destinations for global high-tech investments. Many multinational companies (MNCs) set up operations here because of our skilled workforce, strategic location, and business-friendly environment.

But as these companies operate across different countries, they often trade with their own related companies abroad โ€” buying, selling, or sharing things like:
๐Ÿ’ป Technology and intellectual property
๐Ÿญ Manufacturing services and materials
๐Ÿ’ฐ Loans or financial arrangements

These are called cross-border transactions, and thatโ€™s where Transfer Pricing (TP) comes in.

๐Ÿ’ก What is Transfer Pricing (TP)?

Transfer pricing is about setting the right prices for transactions between related companies in different countries โ€” prices that are fair and reflect market value (known as the armโ€™s length principle).

This ensures:
โœ… Profits are properly taxed where the real economic activity happens
โœ… Compliance with tax laws like Malaysiaโ€™s TP Rules and MTPG 2024
โœ… Reduced risk of tax penalties or disputes with authorities

๐ŸŒ Why TP Matters in the Semiconductor Value Chain

The semiconductor industry is global โ€” design in one country, manufacturing in another, and testing somewhere else.
Because of this complexity, accurate transfer pricing is essential to:
๐Ÿ“Š Manage tax risks across multiple jurisdictions
๐Ÿ“ˆ Support sustainable business models
โš–๏ธ Stay compliant while remaining competitive

๐Ÿง  In Simple Terms

Transfer pricing helps global tech companies play fair, stay compliant, and avoid tax risks โ€” especially in fast-moving sectors like semiconductors where value creation spans many countries.

Malaysiaโ€™s focus on this area ensures that both investors and regulators can grow together โ€” transparently and sustainably.

๐Ÿ“ˆ Conclusion: Malaysiaโ€™s Growing Role in the Global Semiconductor Industry

Malaysiaโ€™s semiconductor industry has been identified as a key growth area under the New Industrial Master Plan (NIMP) 2030 and the National Semiconductor Strategy.
These national frameworks aim to position Malaysia as a global semiconductor hub โ€” attracting more high-tech investments, encouraging advanced technology adoption, and nurturing a skilled local workforce.

โš™๏ธ Why Transfer Pricing (TP) Matters

As more multinational enterprises (MNEs) invest in Malaysiaโ€™s semiconductor sector, Transfer Pricing (TP) management becomes increasingly important.
The semiconductor value chain is complex โ€” involving:
๐Ÿญ Global manufacturing and testing across multiple countries
๐Ÿ’ฐ High capital investments
๐Ÿ“ฆ A wide range of specialised products

Because of these factors, setting the right transfer prices between related companies is not straightforward. TP analyses depend heavily on understanding how each business unit operates, especially in manufacturing.

โš–๏ธ Balancing Strategy and Compliance

With new updates under Malaysiaโ€™s TP Rules and MTPG 2024, and amid global trade and geopolitical shifts, TP compliance is no longer just about avoiding tax risks.
Itโ€™s about finding the right balance โ€” aligning business strategy, regulatory compliance, and sustainable growth.

๐Ÿ’ฌ Final Thought

Malaysiaโ€™s push to become a global semiconductor powerhouse opens vast opportunities for investors โ€” but also brings greater responsibility.
Strategic TP management helps ensure that MNEs remain compliant, efficient, and competitive in this fast-evolving industry.
