Grateful for the opportunity to conduct a for the HR Department at BIPO Services Malaysia.

What made this workshop particularly meaningful was the opportunity to go beyond textbook knowledge and bring real-world payroll tax and audit experience into the training room.

As a , I was able to add value by sharing practical insights drawn from my experience in handling actual LHDN payroll audit matters including the types of issues that may arise, documentation challenges, /MTD discrepancies, treatment of employee benefits and allowances, and how employers can respond effectively during an audit.

A key part of the workshop was the use of practical . Participants were given different payroll tax and LHDN audit to , discuss and determine the and .

This created an interactive environment where participants could apply the tax rules to situations that HR and payroll teams may actually encounter in their day-to-day work.

I believe this is where being a practising tax agent adds significant value to training.

Tax Audit Case Finding:

Are Intercompany Loans Really Tax-Free?

One of the common findings during a tax audit involves intercompany loans.

In a recent case, the concluded that amounts recorded as intercompany loans were, in substance, revenue expenditure rather than genuine loan transactions.

πŸ” What triggered the finding?

- No formal loan agreement.
- No repayment schedule or evidence of repayments.
- No commercial justification for the advances.
- Transactions repeatedly funded the recipient's operating expenses.
- Poor documentation to support the loan arrangement.

As a result, the tax authority looked beyond the accounting entries and assessed the transactions based on their economic substance, leading to additional tax exposure.

Key takeaway for businesses:
βœ”οΈ Prepare proper loan agreements.
βœ”οΈ Maintain board resolutions approving the loans.
βœ”οΈ Keep evidence of fund transfers and repayments.
βœ”οΈ Ensure interest terms (where applicable) are commercially justifiable.
