₹7.23 Crore Income Tax Demand Set Aside

A taxpayer faced reassessment for AY 2020-21, with income assessed at approximately ₹9.90 Crores and a resulting tax demand of ₹7.23 Crores.
Dsquare reviewed the reassessment proceedings, identified a jurisdictional issue, and coordinated the challenge before the Hon’ble High Court of Andhra Pradesh.

The Court ultimately held that the impugned proceedings were not in accordance with the prescribed faceless mechanism under Section 151A and set aside the notices/orders along with consequential proceedings.

⚖️ ₹42.76 Crore Income Tax Demand – Recovery Stayed

A taxpayer with turnover of approximately ₹113.34 Crores and returned income of around ₹87 Lakhs faced an assessment in which purchases of ₹98.52 Crores were disallowed. This increased the assessed income to approximately ₹99.39 Crores and resulted in a demand of ₹42.76 Crores including interest.

Our team reviewed the complete assessment records, compiled supporting information, filed the appeal before CIT(A), and pursued the matter under the High-Pitched Scrutiny Assessment mechanism. Significant purchase transactions were supported through TDS/TCS trails and other documentary evidence.

The Committee considered the assessment as High-Pitched and recommended protection from coercive recovery. Accordingly, the Principal Commissioner of Income Tax directed stay of collection of the outstanding demand until disposal of the first appeal.

A taxpayer received a Service Tax demand, along with interest and penalty, on activities executed for a Government project under the erstwhile Service Tax regime. The matter involved interpretation of exemption provisions, limitation, and other legal issues.

₹1.31 Crore Income Tax Demand Stayed by the Hon'ble High Court. ⚖️

The Income Tax Department reopened the assessment under Sections 148A, 148 & 147 and raised a demand of ₹1.31 crore based on alleged undisclosed transactions.

The Dsquare Legal Team challenged the reassessment proceedings before the Hon'ble High Court for the State of Telangana, highlighting procedural violations in the reassessment process.

⚖️ Another Milestone in Income Tax Litigation
