Under the Income Tax Act, 1961, the term ‘Relative’ is specifically defined (Section 56) — and this definition is crucial to determine taxability of gifts 👇

As per law, in case of an Individual, ‘Relative’ includes:

✔️ Spouse of the individual
✔️ Brother or Sister of the individual
✔️ Brother or Sister of the spouse
✔️ Brother or Sister of either of the parents
✔️ Any lineal ascendant or descendant of the individual
✔️ Any lineal ascendant or descendant of the spouse
✔️ Spouse of all the above persons

👉 Accordingly, gifts received from the above specified relatives are fully exempt from tax, without any monetary threshold.

❌ However, gifts received from non-relatives exceeding ₹50,000 (in aggregate) are taxable under the head ‘Income from Other Sources’.

⚠️ It is advisable to maintain proper documentation such as:
• Gift Deed
• Banking trail
• Identity of donor

Clarity in law avoids unnecessary tax exposure
