of Income Tax Proceedings Based on "Reason to Suspect" and Roving Inquiry..!!

"Reason to Believe" vs. "Reason to Suspect":
The law requires a "reason to believe," which is a higher threshold than a "reason to suspect." As held in cases like CIT vs. Smt. Paramjit Kaur and East Delhi Leasing P. Ltd. vs. ITO, reassessment powers cannot be used for "rowing and fishing enquiries."

Retrospective Justification: The AO first concluded in the Section 148A(d) order that the withdrawal is escaped income. Subsequently, by issuing a notice under Section 142(1) asking for the purpose of the withdrawal, the AO implicitly admits that the nature of the transaction was unknown at the time of forming the belief. This is a classic example of initiating proceedings to investigate, which is impermissible.

Relevant Case Law:
The Gujarat High Court in BAKULBHAI RAMANLAL PATEL vs ITO [(2011) 56 DTR 212 (Guj. HC)] quashed a reopening notice where the AO's reasons indicated a need for "detailed investigation/verification," holding that this reflects a reason to suspect, not believe.

Similarly, in Mukesh Manubhai Shah vs. ACIT [(2025) 182 taxmann com 13 (Guj. HC)], the Court held that the scope of Section 148A is restricted to verifying information that suggests escaped income and does not permit a general or "roving inquiry."
