RBI’s New Draft Rules on Mis-Selling of insurance and other products by banks (Effective July 1, 2026)
■ Every product needs your separate, clear, recorded consent. No bundled checkboxes. No hidden approvals.
■ Mis-selling Clearly Defined - Even if you “agreed,” it is still mis-selling if:
• The product was unsuitable for your profile
• You were misled or not given full information
• It was sold without proper consent
• It was compulsorily bundled
■ Banks must assess whether the product matches your age, income, risk tolerance, financial literacy, etc. Selling an unsuitable product itself counts as mis-selling.
■ A bank cannot force to buy insurance or any third-party product along with a loan or other service.
■ No false urgency, hidden charges, default add-ons, subscription traps, misleading pop-ups, or manipulative UI designs.
■ If mis-selling is established: Full refund of the amount paid. Compensation for financial loss
■ Banks must contact customers within 30 days to confirm they understood the product and its risks.
■ Sales calls only between 9 AM and 6 PM (unless you authorise otherwise). No coercion or misleading representations.

The burden now shifts clearly onto the bank. If a product is pushed, bundled, unsuitable, misleading, or sold through manipulation; you are legally protected. Public comments invited till March 4, 2026.
