Adding value and managing risk with property tax reliefs in property development and investment.

E³ Consulting is hosting a Developer & Investor Roundtable event at the livery hall of the Worshipful Company of Information Technologists, focussing on the areas where value can be added and risk avoided during a construction project lifespan.

We will be focussing on opportunities for developers relating to their Community Infrastructure Levy (CIL) liabilities, cleaning up contaminated or long-term derelict sites, through Land Remediation Tax Relief (LRTR) and other property tax savings.

We have also invited two further contributors to the event, who will be providing further insight from the marketplace on key current areas of value and risk - including aspects of technology in design and construction.

Our Roundtable events are under ‘Chatham House Rules’ with no recording and designed to promote the sessions to be as interactive as possible for sharing ideas, asking questions from real-life examples, and promoting conversation points from the value and risk areas we put forward. We are also limiting numbers to provide the best possible roundtable session for those involved. Hence early booking will be essential to secure your place, first come, first served.

The roundtable event will include teas and coffee, presentations and including case studies, and followed by buffet lunch, with continuing discussions.

As we approach the end of another year, we thought we would take a moment to thank our valued clients, contacts and suppliers for your continued support. It is always much appreciated.

What a busy year!
Throughout 2025 we have worked tirelessly to excel in helping our clients save money through our proactive customer relationships and dialogue.

Whilst different service lines have different profiles, we are delighted to have long-held and enduring client relationships, as well as a continued inflow of new relationships; many originating with referrals from others – be they existing clients, suppliers, professional advisers or other word of mouth introductions – sparked by a conversation at a conference, a network event, a article, or even in person meetings (which we are finding more important now than ever before, whether that be or further afield).

Thankful for what we have...
We take great pleasure in reciprocating introductions with our wider business partners - that we know and trust - having worked alongside over many years, wherever possible. We look forward to further successful collaborations throughout 2026 and beyond!

With market sentiment somewhat dented over the last few months, not helped by the rumour mill and 'kite flying' of the Government/Chancellor in the run up to the Budget, we have sought to maintain a positive outlook and continued to focus on helping our clients optimise their property tax positions - whilst managing compliance, risk and boosting cashflow.

Whilst ensuring it is done in a manner cognisant of the wider world challenges, particularly environmental and climate – as we seek to ensure a timely progression towards Net Zero for both our business and our clients.

At this time, particularly, we think of those in peril and/or facing hardship – ensuring we remain humble and thankful, keeping our own challenges in perspective.

Consulting has advised on for more than ten years and seen some truly awful situations where significant CIL has resulted from situations outside of the homeowners' control, as well as seemingly 'minor' errors by those undertaking the projects, and on occasions poor advice from both councils and advisers. These rigid and poorly devised Regulations had penalised form errors with huge levy costs, surcharges and interest. Thankfully some modification since 01 September 2019 has 'softened' or removed the worst consequences - but CIL remains far from perfect!!

Timely advice... BEFORE WORKS COMMENCE... can often (not always) alleviate much of the risk, pain and cost.

CIL Reg.55 potentially introduces a relief, at the discretion of the LPA, for 'exceptional circumstances'. However, this Regulation is currently optional - meaning many LPAs have not opted to operate this relief. Furthermore, the criteria for relief also currently requires s.106 contributions to be a qualifying condition. The problems illustrated by a small selection of cases in Melissa York The Times and The Sunday Times article (paper 20/07/2025 - online 19/07) could readily be resolved by modifying Reg.55.

Firstly making Reg.55 mandatory for all LPAs and also modifying the conditions so that s.106 could remain a factor but not necessarily a precondition, plus other new options to provide true discretion to the LPAs to determine relief for 'exceptional circumstances' in light of the potential financial impact, nature of any procedural errors and/or project/site circumstances. This would give LPAs a lawful way to reconsider the impact of CIL on the project, families, or individuals and reduce or withdraw the CIL, where appropriate.

Of course, one person's 'appropriate' will not necessarily match others consideration of "exceptional"! Thus, perhaps a new appeal process to either the Valuation Office Agency ( ) or the Planning Inspectorate ( ), may also be necessary; extending the current options.

This could be a relatively 'quick fix' to give a lawful route for to apply common sense in those cases where circumstances have been exceptional, yet the planning process has resulting in an unfair or disproportionate CIL liability. Transparency could be enhanced by incorporating broad guidance on the respective LPA's approach to a revised Reg.55 and what might be considered 'exceptional circumstances' within the relevant CIL Charging Schedule.

We have helped clients up and down the country with CIL from a few hundred ££ to many millions £££ and everything in between. Ensuring that the 'correct' CIL amount is paid, or exemptions and relief - where appropriate - are applied.
