🚧 CIS rules changed from 6 April 2026 — are you compliant?

Construction Industry Scheme (CIS) contractors must now:
📌 File monthly CIS returns — including nil returns
OR
📌 Submit an inactivity request in advance

Late filing penalties are back too:
❗ £100 initial penalty
❗ Additional penalties after 2, 6 and 12 months

HMRC also now has stronger powers where fraud is suspected, including immediate removal of Gross Payment Status.

🏗️ Not all project costs qualify for capital allowances.

The Supreme Court recently ruled that pre-construction costs such as environmental surveys and feasibility studies did NOT qualify for capital allowances in a major offshore wind farm case.

The key takeaway?
Costs must be directly linked to providing the asset itself — not just preparing for it.

Before assuming all upfront project costs are tax-deductible, it’s worth reviewing them carefully. Early planning can prevent costly surprises later.

🍬 VAT on marshmallows? Yes, really.

A recent tribunal case ruled that “Mega Marshmallows” can be zero-rated for VAT because they’re usually roasted or used in s’mores — not typically eaten with fingers like confectionery.

Current position:
✅ Mega marshmallows – zero-rated
✅ Mini marshmallows sold for baking – zero-rated
❌ Standard marshmallows – still subject to 20% VAT

💷 Director or shareholder loan accounts? Watch out for the s.455 tax charge.

If a close company makes a loan to a shareholder and it isn’t repaid within the accounting period, the company could face a corporation tax charge.

⚠️ From 6 April 2026, the rate increased to 35.75%.

Relief may be available if the loan is repaid within 9 months of the year end — but timing matters.

📢 Making Tax Digital for Income Tax is now LIVE

If you’re self-employed or a landlord with qualifying income over £50,000 in 2024/25, you may already be mandated into MTD from 6 April 2026.

✔️ Keep digital records
✔️ Submit quarterly updates to HMRC
✔️ Use compatible software

And if your income exceeds £30,000 in 2025/26, you’ll likely join the regime from April 2027.

The good news? This doesn’t mean paying tax 4 times a year — just reporting more regularly.
