Imagine a line-up of marshmallows arranged by size being inspected by the taxman.

Mini-marshmallows you might enjoy on top of hot chocolate, or use in a rocky road recipe. Verdict: a cooking ingredient, with a VAT rate of 0%.

The middle ones you might typically eat with your fingers, so they are judged to be confectionery with a 20% VAT rate.

The status of the mega marshmallow is trickier. You could just stuff them in your mouth, incurring a 20% VAT rate. But arguably, they’re nicer when toasted over an open fire and put in a cookie sandwich – falling under a 0% VAT rate.

It is a conundrum that has occupied some of Britain’s finest legal brains for years.

Such dilemmas have also haunted the manufacturers of other popular food items including Jaffa cakes, poppadoms and Marks & Spencer’s viral strawberry sandwich.

Determining the VAT status of food stuffs is a quirk of the UK’s hideously complex tax rulebook, which at the latest count covers 23,522 pages – the longest in the world.
