That is why having a Lasting Power of Attorney (LPA) is crucial for anyone who wants to secure their future and safeguard themselves against unforeseen circumstances.

An LPA is a legal document that allows someone you have selected to make decisions for you when you are no longer able to do so. ~ Lasting Powers of Attorneys ~

“A lasting power of attorney is one of the most important documents you will hold…”

Very few people realise what would happen if they lost their mental capacity. Nobody - not even a spouse - has an automatic right to manage another individual's financial affairs or to make decisions regarding their health care.

If you lose mental capacity, all financial accounts - including jointly held ones - are frozen until someone is successful in applying to the Court of Protection to become a Deputy of the Court.

This is a lengthy, intrusive and expensive process and is not guaranteed to lead to the outcome hoped for.

It is not uncommon for the Court to grant Deputies powers to deal with low level day-to-day transactions up to certain monetary limits, but to require fresh applications to carry out more significant transactions such as the encashment of investments or sale of property. By creating Lasting Powers of Attorney whilst you have capacity, it is possible for you to nominate one or more individuals to act as your Attorney (or Replacement Attorney) in the event that you lose capacity in the future.

Attorneys must still register with the Office of the Public Guardian, but the process is much quicker and (unless you dictate otherwise) your chosen Attorney(s) will have complete discretion in how they manage the your affairs.
