๐Ÿ“ข Foreign Resident CGT Changes from 1 October 2026

New changes to Australiaโ€™s Foreign Resident Capital Gains Tax (CGT) regime will take effect from 1 October 2026.

These changes may affect foreign resident clients disposing of Australian assets, including real property and certain interests in Australian entities.

๐Ÿ”น Key changes include:

โ€ข A new definition of real property under Commonwealth law
โ€ข The principal asset test will change from a point-in-time test to a 365-day testing period
โ€ข New requirements for certain vendor declarations involving disposals of $50 million or more
โ€ข Purchasers must consider whether a vendor declaration remains reliable before settlement
โ€ข A temporary 50% CGT discount will apply to eligible non-individual foreign residents disposing of certain renewable energy assets

๐Ÿ“Œ What does this mean for tax professionals?

Foreign resident clients with Australian property or investments may need their CGT position reviewed before a disposal.

This includes considering:

โ€ข How the property is used
โ€ข How long it is available for rental
โ€ข Private use by the owner, family or friends
โ€ข Availability for rental during peak periods such as school holidays and public holidays

Upcoming FBT Changes from 1 April 2027

14/09/2026

๐Ÿ“ข Upcoming FBT Changes from 1 April 2027

The ATO has announced changes to Fringe Benefits Tax (FBT) that may affect employers providing salary sacrificed work-related benefits.

Here are the key changes:

๐Ÿ”น Some work-related expenses
The โ€˜otherwise deductibleโ€™ rule will no longer reduce FBT for certain salary sacrificed expenses, including home office, home phone/internet and self-education expenses.

๐Ÿ”น Some work-related items
Certain items, such as laptops, software, protective clothing, briefcases and tools of trade, will no longer be FBT-exempt when provided through a salary sacrifice arrangement.

๐Ÿ”นMultiple work-related items
Employers will be able to provide more than one eligible work-related item in an FBT year, provided the items are mainly used for work and are not provided through salary sacrifice.

๐Ÿ“… These changes apply from 1 April 2027.

Employers providing salary sacrificed work-related benefits should be aware of these changes and consider whether they may affect their FBT obligations.
