You're About to Hire Someone. Employee or Contractor?

Before you write the contract, ask yourself these questions:

**Question 1: Will you control their hours?**
If YES → They're likely an employee
If NO → Could be a contractor

**Question 2: Will you provide the equipment they need?**
If YES → They're likely an employee
If NO → Could be a contractor

**Question 3: Can they work for your competitors?**
If YES → Could be a contractor
If NO → They're likely an employee

**Question 4: Will they set their own rates?**
If YES → Could be a contractor
If NO → They're likely an employee

**Question 5: Can they refuse work without consequence?**
If YES → Could be a contractor
If NO → They're likely an employee

Most "YES" answers to the first two questions? You're hiring an employee.

Most "YES" answers to the last three? You might have a true contractor.

The key: your actual working relationship matters more than what the contract says.
