💼 Looking to invest in rental property? Consider leveraging your super!
🏠 Did you know that purchasing a rental property using your superannuation is possible? Investing in property can be a smart strategy to grow your wealth over the long term, and your super can help make it happen.

✅ Benefits of using your super for property investment:
1️⃣ Tax advantages: By purchasing a rental property through your self-managed super fund (SMSF), you may benefit from potential tax advantages, such as rental income being taxed at a lower rate compared to personal income.
2️⃣ Diversification: Investing in property diversifies your investment portfolio and potentially reduces risk.
3️⃣ Long-term growth potential: Historically, property investments have shown solid long-term growth, making it an attractive option for building wealth.

📊 However, it's essential to consider the following:
1️⃣ Superannuation regulations: Specific rules and regulations surrounding property investments within an SMSF. Seeking advice from a qualified financial professional is crucial to ensure compliance.
2️⃣ Cash flow management: Properly managing cash flow is important to cover expenses such as property maintenance, loan repayments, and any potential vacancy periods.
3️⃣ Investment strategy: Developing a clear investment strategy aligned with your financial goals is key. Consider factors such as location, rental demand, and potential return on investment.

📞 Contact Amour Accountants today to discuss your property investment goals and understand how your superannuation can be utilized wisely. Our team of experts will provide personalized advice tailored to your needs. Let's explore the possibilities together!

Remember to lodge your SAR by 31 October.

If your self-managed super fund (SMSF) had assets on 30 June 2022, then you need to lodge an SMSF annual return (SAR) for the 2021–22 financial year. Your lodgment due date will depend on your circumstances.

If you're a new SMSF and are preparing the SAR yourself, or if you have previously lodged a late SAR, your due date is 31 October 2022.

Home‑based business expenses

This information will help you if you are a small business owner claiming deductions for the costs of using your home as your main place of business.

Key points
• The types of expenses you can claim depend on how you operate your business from your home.
• You can only claim deductions for the portion of your expenses that relate to running your business.
• You must keep records for at least 5 years to show that your business incurred the expenses and how you calculated your claim. • If you sell your home, there may be capital gains tax (CGT) implications.
• If you are entitled to goods and services tax (GST) input tax credits, you must claim your deduction in your income tax return at the GST exclusive amount.

The joint publication from AFSA, ASIC and ARITA also offers practical guidance to company directors facing financial distress, to seek qualified professional advice and act on that advice.

Consult a qualified legal practitioner

Business failure can result in legally complicated outcomes, including asset recovery actions and penalties against the individual at fault, if they fail to comply with their legal obligations. In addition, declaring bankruptcy can have serious consequences.

Hence, it is advisable for an individual who may be facing financial difficulties in their business to consult a qualified legal practitioner as soon as possible. Other professionals to consult may include a registered trustee or liquidator. Many trustees are also liquidators; however, by law they cannot act in both capacities at the same time for an individual and their company. Once appointed, a trustee or liquidator acts for the benefit of an individual or company’s creditors and not for the benefit of an individual personally.

Be wary of untrustworthy advisers
Certain advisers may target individuals or company directors whose businesses or individual circumstances may be facing financial distress and hence are vulnerable to taking action which could be illegal. Such actions can lead to serious consequences for individuals and company directors, including large fines or imprisonment. It is important for individuals to know what they are paying for, and that the advice received does not give rise to a breach of law or duties. The warning signs for an untrustworthy adviser, include:

• contacting an individual unexpectedly,

• remaining reluctant to provide their advice in writing; a written record of advice is always recommended,

• referring to themselves as a “friendly” trustee or liquidator,

• suggesting the transfer of assets which are owned by an individual, or their company, to another party or company without that party or company paying full value for those assets; such action could damage the individual’s claims or those of the company’s creditors, and

• advising an individual to withhold, or delay, providing their business records to their trustee or providing the company’s books and records to their liquidator; this is an offence.
