Mutation Law 2026: वसीयत और म्यूटेशन पर सुप्रीम कोर्ट का ऐतिहासिक फैसला | Tarachandra vs Bhawarlal (2024)

Ruling: Supreme Court ne saaf kiya hai ki agar kisi registered vasiyat (Will) par sage kaanooni variso (Natural Heirs) ko koi gabhir apatti nahi hai, toh Revenue Department/Tehsildar vasiyat ke aadhar par mutation karne se mana nahi kar sakta. Mutation entries sirf fiscal purpose (land revenue/tax collect karne) ke liye hoti hain aur isse ownership (Title) confer nahi hota. Agar kisi third party ko unregistered agreement ke dum par vivad khada karna hai, toh use Civil Court jana hoga, Tehsildar ke paas iska jurisdiction nahi hai.

2. Jitendra Singh vs. State of Madhya Pradesh (2021 SCC OnLine SC 802)
Ruling: Supreme Court ne saaf kiya ki Tehsildar ya Revenue Officers ke paas kisi bhi disputed document ki validity ki jaanch karne ka koi judicial adhikar nahi hai. Title ya ownership dispute ka adjudication kewal competent Civil Court hi karega, Revenue Department nahi.
