All biological children will receive equal rights in inheritance and gifting

⚖️ The Dutch government is preparing an important change:
Starting 1 January 2026, all biological children will be treated the same as legal children when it comes to inheritance and gift tax.

👉 This means that even if a child was not officially recognized at birth, they will still be entitled to inheritance or gifts under the same conditions as other children.

🧬 The only requirement — proof of kinship through a DNA test.

📌 Important: the new rules apply only to inheritances and gifts arranged after 16 September 2025. Everything recorded with a notary earlier — wills, contracts, or gift deeds — will remain under the old rules.

đź’¶ Cash payments are becoming a thing of the past

Starting 1 January 2026, a new rule takes effect in the Netherlands: cash payments of €3,000 or more for goods will be banned.

What does this mean in practice?
👉 You won’t be able to pay more than €2,999.99 in cash for goods.
👉 The restriction applies only to shops and traders selling goods.
👉 Private transactions between individuals are not affected (for now).
👉 Paying for services in cash is still possible, but from 2027 new EU-level restrictions are expected here as well.

âť“ Why this change?
To make it harder for people to launder money or hide income through large cash transactions.

âś… What entrepreneurs should keep in mind:
If your business involves high-value sales, start preparing now — add convenient non-cash payment options and inform your clients.

The Dutch government wants to close a “loophole” in taxes for spouses.
Currently, spouses can arrange an unequal division of their joint assets with a notary (for example, 90/10 instead of 50/50). In the event of one partner’s death, this reduces or even completely eliminates inheritance tax.

⚖️ What changes:
From 16 September 2025, the tax will be calculated as if each spouse owns 50%, even if a different division is agreed on paper.

đź’ˇ Example:
A couple has joint assets of €3,000,000.

Before 16.09.2025:
Division 90/10. If partner A dies, partner B inherits 10% (€300,000). This amount is below the partner’s tax allowance, so no inheritance tax is due. Saving: €123,641.

After 16.09.2025:
Even with a 90/10 division, the tax will be calculated as if it were 50%. That is €1,500,000 minus the allowance, resulting in inheritance tax of €123,641.

📌 For couples who already agreed on an unequal division before 16 September 2025, nothing changes.
📌 The new rules only apply to agreements made after this date.

✨ The idea is simple: spouses should pay a fair tax and not avoid it through “paper constructions.”
According to estimates, the government will raise an additional €4 million per year with this measure.

Starting in 2026, an important change will take effect in the Netherlands regarding the rules for paying inheritance tax (erfbelasting).

📌 The main change: the deadline for filing the tax return will be extended from 8 to 20 months.

What does this mean in practice?

âś… Heirs will have almost 2.5 times more time to gather documents and work out the numbers.
âś… The actual payment of the tax will also be postponed, giving more room for careful planning.
✅ This is especially useful in situations where part of the inheritance is “locked” in real estate or other assets that cannot be quickly converted into cash.

đź§ľ Interest for late payment will no longer start after 8 months, but only after 20 months.
This means there is extra time to settle everything without haste and unnecessary costs.

✅ In the Netherlands, many starting entrepreneurs choose the EMZ form. It’s simple, fast, and inexpensive. On top of that, EMZ offers tax benefits that help reduce payments to the budget. But there are situations when it’s safer and more profitable to open a BV. Here’s a real story:

💻 Alexey moved to the Netherlands from Ukraine 🇺🇦 and works as a freelancer in IT. He earns well and wanted to officially register his activities. At first, he thought about EMZ — that’s what almost everyone does. But during a consultation at Nalog.nl, it turned out that almost all of his income comes from one large client.

⚠️ In such cases, the tax authorities may classify entrepreneurship as fictitious: it looks like freelancing, but in reality it resembles regular employment. And then not only the entrepreneur, but also the client can face problems — fines and questions from the tax office.

🏢 Alexey truly works for himself, but proving this is difficult. To avoid risks, we suggested another option — registering a BV.

💶 And it turned out to be not only safer but also more profitable. Alexey’s income is around €150,000 per year. And starting from about €120,000, a BV becomes the smarter choice: the corporate tax rate is lower than income tax, and EMZ tax deductions no longer cover the difference.

👍 In the end, Alexey not only opened a BV with our help but also entrusted us with the accounting support for his company. Now he can fully focus on his work, while we take care of the taxes.

On September 9, 2025, officers of the Fiscal Information and Investigation Service (FIOD) carried out an arrest as part of a tax fraud investigation. A 48-year-old resident of Amsterdam and his 65-year-old accountant from Utrecht were taken into custody.

Both are suspected of filing tax returns with deliberately false information. The man claimed to be a tax non-resident; however, the investigation established that he maintained strong personal and economic ties with the Netherlands, including property, bank accounts, and employment.

A court had previously ruled that his tax status should be considered that of a domestic tax resident. Nevertheless, the tax returns continued to be filed as if he were a non-resident.

The preliminary loss to the state budget is estimated at more than €100,000.

FIOD emphasizes that tax fraud is a serious offense and entails not only financial penalties but also criminal prosecution.

A great business idea doesn’t always get realized quickly — more often, it comes down to financing. Finding an investor is not easy, but having a private company (BV) makes the process much smoother. Why do investors prefer BV? We’ll show you an example from our clients.

The business idea and its preparation
Andrey and Inna had long been thinking about starting their own business. They noticed the growing public interest in ecology and decided to launch a startup producing biodegradable packaging.

They presented their project at several startup events in the Netherlands, where they met a venture investor interested in eco-friendly technologies. His key condition was to establish a BV (Besloten Vennootschap). The proposal turned out to be beneficial for both Andrey and Inna.
