UK small business owners who fail to pay their employees the minimum wage will face Government fines of up to £20,000, according to reports.

Previously rogue SME employers were required to pay underpaid wages in full including a fine of 50 per cent of unpaid wages up to a maximum of £5,000. However, in a bid to scare employers into action, this figure will now rise to 100 per cent.

Vince Cable, business secretary, is due to say: "Anyone entitled to the national minimum wage should receive it. Paying anything less than this is unacceptable, illegal and will be punished by law.

"So we are bringing in tougher financial penalties to crackdown on those who do not play by the rules. The message is clear – if you break the law, you will face action.

"The national minimum wage plays an important role in supporting low-paid workers whilst making sure they can still find work. Enforcing this is a key to fairness in our workforce."

Providing the legislation is approved the new rules are expected to come into play next month.

In its latest campaign, HMRC is going after 50,000 businesses that it believes have failed to submit VAT returns. Of the 600,000 businesses that submit a VAT return each month, around 1-in-12 have been told to submit one but have not done so. These companies will be given until 28 February to submit documentation and pay any outstanding VAT.

After that date HMRC will be taking a much closer look at their tax affairs.

HMRC's investigation is similar to the clampdown on buy-to-let landlords earlier this year, where task-forces were launched on the areas of Durham, East Anglia, Leeds, Leicester, Lincoln, London, Nottingham, Sunderland and York in order to reclaim unpaid tax, with HMRC director Mike Eland saying that deliberately evading tax “can land you a heavy fine or even a criminal prosecution as well”.

The Government are currently making a big issue of morals and taxation; trying to encourage taxpayers to pay what they consider is the ‘right’ amount of tax rather than necessarily what they are legally obliged to pay. However, when the boot is on the other foot, it appears HMRC are quite prepared to ignore morality and apply the law to their advantage.
